Terms of Service

1. Acceptance of Terms

By accessing or using the eSIM Agents wholesale platform (“Platform”) at esim.agents.co.th, you agree to be bound by these Terms of Service (“Terms”). If you are accessing the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you must not use the Platform.

2. Eligibility & KYC Verification

The Platform is available exclusively to verified business entities operating in the travel, tourism, and hospitality industry. Access requires successful completion of our Know Your Customer (“KYC”) verification process. We reserve the right to deny or revoke access to any account at our sole discretion, including if we determine that a business does not meet our eligibility criteria or has provided inaccurate information during verification.

3. Account Registration

You register using your business email address via a one-time password (“OTP”) process. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to notify us immediately of any unauthorized use of your account.

4. Wholesale eSIM Products & Orders

All eSIM products listed on the Platform are intended for resale to end consumers travelling to or within Thailand. Orders are fulfilled digitally and are generally non-refundable once an eSIM activation code has been issued. Pricing is subject to change without notice; however, the price applicable to a confirmed order will be the price displayed at the time of order placement.

Pricing tiers are determined by your total purchase volume over a rolling 12-month period. Placing a single larger order may advance your pricing tier immediately for that order. There is no minimum order quantity; orders of 1 eSIM are accepted.

5. API Usage

API access is granted to verified accounts and is subject to fair use rate limits. You must not use the API to create automated systems that circumvent pricing controls, resell API access to third parties, or use the API for any unlawful purpose. We reserve the right to revoke API access at any time for violation of these Terms.

6. Account Balance & Payments

Purchases are made against a pre-funded account balance. Balances are non-transferable and non-refundable except at our discretion. In the event of account termination, any unused balance may be refunded subject to verification and deduction of applicable fees.

7. Prohibited Uses

You agree not to use the Platform to: (a) violate any applicable law or regulation; (b) resell eSIMs to other wholesale distributors without prior written consent; (c) interfere with or disrupt the integrity or performance of the Platform; (d) attempt to gain unauthorized access to the Platform or its related systems; or (e) engage in any fraudulent activity.

8. Limitation of Liability

To the maximum extent permitted by applicable law, eSIM Agents Co., Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of revenue, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

9. Intellectual Property

All content, trademarks, and intellectual property on the Platform are owned by eSIM Agents Co., Ltd. or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or brand names.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via the email address associated with their account. Continued use of the Platform after such notification constitutes acceptance of the revised Terms.
